US State Regulators Issue AI Examination Framework for Banks, Filling Gap as Federal Guidance Remains Absent

US State Regulators Issue AI Examination Framework for Banks, Filling Gap as Federal Guidance Remains Absent
The Conference of State Bank Supervisors (CSBS) released its Artificial Intelligence Regulatory Framework on September 16, 2026. Aimed at state-chartered banks and state-licensed nonbank financial institutions, the framework provides examiners with a process to identify AI use, assess related risks, and determine whether to initiate deeper reviews. It includes core examination guidance, detailed work procedures, supplemental materials for nonbank financial institutions, and a worksheet that classifies individual AI applications into different risk tiers. The core guidance covers governance, oversight, AI inventories, specific use cases, generative AI, and other emerging applications; for nonbank institutions, the framework extends to third-party risk, model risk, and consumer protection.
The framework is voluntary, not a nationwide mandate. State regulators may decide the extent of its use, and examinations should reflect an institution's size, complexity, risk profile, and level of AI adoption.
The move comes amid a continuing void in federal-level model risk guidance for generative AI. CSBS's framework could affect fintech companies, lenders, payment firms, and technology platforms operating under state licenses, as well as vendors selling services to regulated institutions.
