ESMA Names AI and Tokenization as EU-Wide Supervisory Priorities for 2027
The European Securities and Markets Authority will coordinate national regulators' oversight of digital innovation, with initial reviews of the most affected firms starting in 2027.
ESMA Puts AI and Tokenization on Its 2027 Agenda
The European Securities and Markets Authority (ESMA) announced on Wednesday that it will include AI and tokenization in its new Union Strategic Supervisory Priorities (USSP) starting in 2027, coordinating national regulators' oversight of digital innovation.
Under the plan, national authorities will map how tokenization is being used in local markets, document how firms are using or plan to use AI and tokenization in products and processes that directly affect investors, and carry out initial reviews of a subset of the most affected companies.
Three Risk Areas Flagged
In its fact sheet, ESMA identified three categories of risk requiring attention:
- Biased or misleading AI outputs
- Product structures that investors struggle to understand
- Reliance on a small number of third-party providers
Regulators also plan to examine how firms disclose emerging technologies to investors and to collect examples of innovation that improve investor outcomes, reduce bias, and ensure reliable results.
Running Alongside Existing Priorities
The priorities are set every three years, with a maximum of two at a time. The new focus will run in parallel with the cyber and operational resilience USSP launched in 2025; ESMA will wrap up another priority on ESG disclosure this year.
