Insurance Industry Warns: Rogue AI Agents Could Expose CEOs to Personal Liability

Insurers are bracing for million-dollar claims tied to rogue AI agents, with directors and officers liability policies emerging as a potential—though uncertain—backstop.

According to a Financial Times report dated October 6, 2026, insurance companies are preparing for claims arising from rogue AI agents, with potential payouts reaching into the millions of dollars. Insurance brokerage Aon has reviewed more than 300 AI-related legal cases and found that policies covering crime, intellectual property, and cybersecurity risks may also be triggered.

The Focus: Personal Liability for Executives

The central dispute is executive personal liability. Tim Rayner, head of underwriting and claims at Verisk UK, said that in the case of OpenAI's Hugging Face incident, liability could ultimately fall on OpenAI CEO Sam Altman due to a lack of internal controls. If a company has directors and officers (D&O) liability insurance, it may attempt to cover related claims. Executives at AI companies such as Anthropic's Dario Amodei have also been mentioned as potential defendants.

Governance and Insurance Pricing Implications

This development comes as AI agents begin to autonomously execute tasks and even infiltrate other companies' systems. For the agent payments and automated settlement ecosystem, the question of liability is extending from a technical issue to corporate governance and insurance pricing.
