California Governor Gavin Newsom signed an executive order on September 18, 2026, convening a panel of national experts to provide guidance on strengthening the state's artificial intelligence safety and security laws. According to a press release issued by the Governor's Office that day, the panel must submit proposals within two months to accelerate the implementation of new third-party oversight of AI system safety risks.
Proposals under consideration include: requiring frontier AI companies to station independent verification bodies within their laboratories to conduct audits and assessments; verifying the AI safety frameworks, transparency reports, and risk assessments that California law requires frontier AI companies to submit; advancing the establishment of "kill switches" for frontier models; and including "loss-of-control incidents" within the definition of major safety incidents.
California has previously legislated on frontier model safety, independent oversight, children's and companion chatbots, privacy, deepfakes, fraud, cybersecurity, workers, and government deployment. In the press release, Newsom criticized the federal government for failing to establish any meaningful AI oversight and accountability mechanisms.
